In 1986, the State of California passed the Safe Drinking
Water and Toxic Enforcement Act, also known as Proposition 65. Compliance
with Prop 65 standards requires manufacturers, retailers and resellers
(distributors) to provide warnings to consumers if a product exposes consumers
to one or more of over 700 chemicals in amounts that the State of California
considers to pose a significant risk of causing harm.
Concepts Plus decorates all products using materials and processes that
comply with current FDA guidelines. As of the publication of this catalog,
the State of California has not established uniform guidelines regarding
decorated glassware or ceramics. The State of California Proposition 65
requirements are in addition to the Federal standards, i.e. voluntary
20mm lip & rim imprint area.
Concepts Plus will use commercially reasonable efforts to decorate all
glass and ceramic products that are known to be shipping to California
with inks that comply with the requirements as indicated in the Boelter
Opt-In Settlement.
Due to the chemical composition of non-vitrified, red and orange ceramic
mugs that are currently available on the market, Concepts Plus will individually
apply Prop 65 compliant warning stickers to all shipments known to be
going to California. Although vitrified red and orange ceramic products
are known to meet Boelter Opt In requirements, incompatibilities with
existing ink systems prevents us from ensuring that their use will result
in consistent, commercially acceptable results.
It is the customer’s responsibility to inform Concepts Plus of all
shipments of decorated glass & ceramic ware going to California. Notification
of California shipping requirements must be received in writing prior
to order production.
Concepts Plus order acknowledgments will also advise that notification
by the customer is required if glass & ceramic jobs shipping outside
California may be redistributed or dropshipped (i.e. fulfillment programs,
etc.) into California at a later date.
If Concepts Plus is not given notice of California shipments, it is the
customer’s responsibility to ensure compliance with Prop 65 requirements.
If any customer sells product that is shipped or redistributed in the
State of California, and does not provide advance notification to Concepts
Plus, the customer will hold Concepts Plus harmless from all liability
for alleged Proposition 65 violations. All costs associated with legal
defense of Prop 65 claims will be the responsibility of the customer.
